The Fairwinds Community Association have been dealing with ongoing issues and concerns on behalf of the resident's of Fairwinds.  In order to keep you informed as to what these concerns are, the steps taken to address them and the responses received we are listing them below.

1.

AMBULANCE SERVICE TO FAIRWINDS COMMUNITY

 

Date:

April 24, 2003

 

Issue:

A resident suffered a heart attack while out walking.  The ambulance was called but it took a long time to arrive.    A request was made to have clearer house numbers as the driver had difficulty reading house numbers. 

 

Steps taken by the FCA:

Looked at companies supplying clear house numbering systems and numbering on the curbs.

invited speaker to October meeting to talk to members of proposal being taken to the government regarding a 24 hour, 7 day ambulance station at the Nanoose Bay Firehall

2.

ANIMAL CONCERNS

(a)

Deerproofing 

 

Date:

Ongoing

 

Issue:

The deer eat almost all plants.  What can be done to protect the gardens.

 

Resolution:

The deer are part of the ambiance of the community.  For tips on deer proofing your gardens can be found at local garden shops.  Remember that your phase will have fence restrictions included in the covenant so be aware of your particular restriction if that is the deer proofing you are going to use.

 

 

 

 (b)

DOG DROPPING CLEAN-UP

 

Date:

April 24, 2003

 

Issue:

Residents walking their dog(s) are not cleaning up after them.  Could signs be put up to remind people to do this.

 

Steps taken by FCA:

At the April meeting residents were asked to clean up after their dogs.  It was felt that most do but it is the few that make it bad for the many.

Looking into signs, this is Fairwinds Community & Resort (FC&R) or the GolfCourse that put up signs in the areas indicated and they did not feel that this was an issue for them.

The majority of residents comply.  Nothing further done

 

 

 

(c)

GEESE & DROPPINGS ON GOLF COURSE

 

Date:

Issue:

Large amount of Canada Geese and their droppings on Golf course

 

Steps taken by FCA:

bullet

Golf course is dealing with this concern on a regular basis but are limited due to restrictions place on them by Wildlife Protection officials.  To decrease the amount of geese they shake the eggs before hatching and use scare tactics (loud shells, decoys, swan).  They have also tried a type of taste repellant on the grass.

Droppings they try to gather in the mornings by dragging the course.

 

Resolution:  April '04

Ongoing battle.  They seemed to like the taste repellant grass and the scare tactics move them from one part of the course to another.  They continue to work on the problem.

2006/2007 - Golf course sent out crew to addle eggs in spring and the use of a laser light at night to discourage geese from nesting seemed to help a lot. 

 

 

 

(d)

OTTER CONTROL AT SCHOONER COVE HOTEL

 

Date:

October 2002

 

Issue:

Resident's concern over the capture and killing of otter at the hotel.   Letters were written asking if they had tried to capture and release the animals or if they had looked into renovations to the marina and hotel that would make access to the area of concern impossible.

 

Steps taken by the FCA:

As this was brought to the attention of the members on an information only presentation, the FCA did nothing formal.  A letter of support for the resident's concerns was sent.

 

Resolution:  April '04

the otter control situation was dealt with and hasn't been started up again.  We will continue to monitor the situation.

 

 

 

3.

BOULEVARD MAINTENANCE

 

Date:

October 2002

 

Issue:

This was brought forward by the resident's of Schooner Ridge that their boulevards were in deplorable condition whereas the ones leading into the Golf Course on Evanshire and Andover were being maintained by Fairwinds.  They wanted to know why there boulevards weren't maintained as well.

 

Steps taken by FCA:

Fairwinds Community & Resort manager was at the meeting that this issue was presented at.  He advised that the boulevards are not the concern of Fairwinds but the golf course does do Evanshire and Andover as these are on the drive leading up to the golf course and effect their landscaping.

FCA learned that Schooner Ridge has a strata fee with the homes there that is to be used for the maintenance of the boulevards and common areas.  Residents should look to their strata council

 

Resolution:  April 2004

Not much has changed.  **Note: In the past year the RDN realized that nobody was paying for the water used on these boulevards.  A water meter has now been installed in each one and Fairwinds has been paying the cost.  This could change at any time.

 

 

 

4.

BROOM REMOVAL

 

Date:

April 2003 & October 2006

 

Issue:

There is a great deal of broom encroaching on developed property.  What can be done to remove it, can residents get together to do the work?

 

Steps taken by FCA:

Contacted Fairwinds and got permission to remove broom from their land and undeveloped land

Tried to contact some lot owners, none reached had any objections.

RDN contacted and they would provide the 'puller' and chipper needed

2006 - request for information on how to proceed with removal

A work party was organized and broom was removed by one community group.  2006 - contact RDN for assistance with broom puller and chipper.

 

 

 

5.

BUILDING GUIDELINE INFRACTIONS -

(a)

PROCESS FOR APPROVALS

Ongoing

 

Issue:

Building guideline infractions are an ongoing problem.  The question asked is who makes the decisions about a building and who gives them the approval to items outside the guidelines?  Does anyone 'police' this.,   What is the process for getting a building approved.

 

Steps taken by FCA:

All building plans must be approved by the RDN & Dave Scott (on behalf of Fairwinds Community & Resort.  He advises that the original plans go to the RDN and himself for approval but any amendments to these plans only go to the RDN so he may not be aware of any of these.

Roger Andrews of Penreal (management company for Fairwinds) was asked about how he handles building infractions.  He stated that he hoped they could be handled diplomatically.

(b)

FENCING

Ocober 2003

 

Issue:

Chain link fencing, around a pool, on a house being built.   The lot is visible from the golf course.  Is this a covenant or building infraction issue?

 

Steps taken by FCA:

Contacted Dave Scott as this is a new house and is still under the building stage.   Dave stated that the deposit would not be returned if the fence stayed up and that letters had been sent to the owner.

 

Resolution:  April '04

Fairwinds Community & Resort does little, if anything, as they don't want to rock the boat.  FCA continues to push.

 

 

 

(c)

HOUSE COLOURS

 

Date:

October 2003

 

Issue:

New house and repainted house  do not conform to building guidelines of "Heritage Colours"

 

Steps taken by FCA:

Roger Andrews of Penreal was asked how they would handle this type of building infraction.  He stated that, in regards to the new house, their building deposit would be withheld until the colour conformed... but he also stated that they could look on this as the 'cost of doing business and paint their house purple anyway.

 

Resolution:  April 2004

This is a building guidelines issue dealt with by Penreal, As yet they have done nothing.  FCA continues to push

 

 

 

6.

CART PATH

(a)

MAINTENANCE

Issue:

Who do you contact to get overgrowth & trees cleaned up along the cart path access to golf course?

 

Steps taken by FCA

FCA contacted Fairwinds Golf Course maintenance and they advise they will look at the area and review the problem.

Area in question cleaned up. 2006 - input on new pathway maintenance was presented to development planning committee

 

 

 

(b)

ADDITIONAL PATHWAYS

Issue:

Resident feels that more cart paths are needed from Schooner Ridge so they don't have to drive on roadways

 

Steps taken by FCA:

Referred to Fairwinds Community and Resort as they are the developers of the neighbourhood and should have these access lanes in their plans

 

Resolution: April 2004

Nothing further done.   2006 - input on new pathway maintenance was presented to development planning committee

 

 

 

7.

CROSSWALK BETWEEN HOLES  9 & 10

 

Date:

October 2003

 

Issue:

Request made that the crosswalk between 9 & 10 be marked better and in a way that would slow traffic down.  This could be achieved by a raised roadbed (speed bump) or ripples.

 

Steps taken by FCA:

Letter was went to the Ministry of Transport (MOT) requesting a review of this crosswalk.  Reply was that it was denied.

 

Resolution:  March 2004

MOT has repainted the markings and made the approach marking much bigger.

 

 

 

8.

COMMUNICATION WITH MEMBERSHIP

 

Date:

October 2002

 

Issue:

Community was not aware of what the FCA was doing on their behalf.  It was expressed that they had trouble getting their concerns to the executive.

 

Steps taken by FCA:

The FCA went to two meetings a year so that membership had a chance to meet with executive more often

Developed ways to keep membership informed:  community newsletter (Good News) and this website.

with regard to main area of concern (covenants) a committee was put in place.

 

Resolutiuon: April 2006

Good News no long printed.  A community newsletter was put out by the FCA but lack of support in putting it together has put it on hold.   FCA uses the email system within the website to notify those that are registered members of the FCA. 

 

 

 

9.

CONSTITUTION

 

Date:

October 2002

 

Issue:

The FCA constitution was the generic "society act" constitution.  If was felt that we needed something directed to the FCA that would take us into the future development of the area.

 

Steps taken by FCA:

10.

CONSTRUCTION SITE CLEAN-UP

 

Date:

April 2003 - continual

 

Issue:

Roadways around construction sites are filthy and when it rains this mud is tracked through the neighbourhood.

 

Steps taken by FCA:

Fairwinds Community & Resort (FC&R) should be monitoring it but they don't want to make the contractors unhappy either.

FCA met with FC&R management and asked them to call in street cleaners and charge the cost to the deposits.  They would not agree to this.

bullet

Dave Scott (of FC&R) stated that he didn't know of any problems unless he was advised.  FCA asked him why he didn't drive around the area once a week anyway and look at potential problems on his own.  No comment given.

Problem still exists.

 

 

 

11.

COVENANT INFRACTIONS

Issue:

Most common complaints include:  boats and RV's parked where visible from road;  unsightly yard upkeep; chain link fencing; trailer parked down the street on vacant lot.

 

Steps taken by FCA:

Covenant committee formed.  This committee will visit with individuals and try to mediate a resolution.

In 1998 a legal fund was started to help FCA investigate where they stood legally.  Legal advise received was that only those directly effected by the infraction could take the offender to court.  Therefore a neighbour would have to sue a neighbour, the FCA can't.

Met with Fairwinds Community & Resort -they will not police

Penreal (FC&R) withdrew from partnership in Covenant Committee.

Covenant Committee disbanded

"Good Neighbour Bylaw" was written and taken to the RDN for adoption as an area bylaw as they instructed After looking thru the paper, most items were deemed inappropriate items for By-law inforcement or they were already covered under existing bylaws so the submitted paper was rejected.

Ongoing concern.  Groups in Nanoose Bay are looking at incorporation which would probably help us in this matter.

 

 

 

11(a) COVENANT AMENDMENTS
  Date: October 2006
  Issue: Older phases have homes that are going to need new roofs.  As cedar shakes are not liked and the only alternative requires major truss replacement to carry weight, can an amendment be made to allow alternatives?
  Steps Taken by FCA:
bulletFairwinds Development is forming a committee to look at new alternatives
bulletFCA to look into what is required to change existing covenants and advise the community
  Results:
bulletA lawyer was consulted - determination was that 100% approval from residents of the relative phase was needed to amend the covenant or the phase could apply to the courts for the judge to make a change.  For the latter it would have to be proven to the judge that the change would benefit all residents of the phase.   All legal papers registered to properties would have to be amended and filed at the home owners expense.
     

12.

EAGLE TREE

(a)

ARTIFICAL TREE

 

Date:

October 2002

 

Issue:

Regarding active eagle nest in tree backing on 13th fairway.  When property owner wanted this tree removed so they could build, the wildlife protection agency said they had to build an artificial tree nearby for the birds to move to before permission would be given.  A telephone pole with a platform on top was put in behind the 14th green.  It is an eyesore and even the eagles wouldn't use it.

 

Steps taken by FCA:

Noted that birds were in the area but not using platform

FCA was advised that artificial platform had to remain for a set length of time before it could be removed.

Nothing more could be done until this time limit was met

 

Resolution:  

February 2004 - Artificial tree was removed by Fairwinds at the end of the designated time period imposed by the Wildlife protection agency   File Closed

 

 

 

(b)

DESIGNATION OF TREE AS PROTECTED

 

Date:

October 2002

 

Issue:

Can residents do something to protect the trees that the eagles use.  Case in question was the topping of the tree at the corner of Andover and Fairwinds Dr where the Observation Point Condos are scheduled to be built.  It was thought that this was a protected tree with a plaque on it stating this.

 

Steps taken by FCA:

Member of FCA who is knowledgeable on the  regulations told us that: trees on private property cannot be designated by general public; once placarded the tree can only be removed by application to the wildlife protection agency should the property sell,

Fairwinds Community & Resort was contacted about the tree that was topped.  FCA was advised that this tree did not have a placard on it and they had an arborist report saying it was decayed/dead on top which necessitated the topping.

 

Resolution:

Nothing further was asked of the FCA

 

 

 

(c)

UNAUTHORIZED TREE REMOVAL

 

Date:

April 2002

 

Issue:

 

 

 

Slept 2006

A waterfront lot on Andover had a placarded eagle tree with an active nest on the property.  The lot owners wanted to sell but could not do this with the tree on it.  In the middle of the night a truck and crane were brought in to remove the nest.. (residents were told it blew down).  The next night the tree was taken down and removed but this was seen by residents and a complaint was made.

Second issue of residents building, removing trees (without permission) from the buffer area between the golf course and their property to 'improve their view'

 

Steps taken by FCA:

RDN had been advised of this situation and were investigating .

bullet

Owners were eventually taken to court and fined $10,000.  In the meantime they sold the property.  For them, this was the 'cost of doing business

 

Resolution:

FCA was not asked to do anything as the municipality was involved.

Issue 2: Fairwinds will take action against those that remove trees on their property.  The buffer zone is there for a reason and some trees are designated 'protected' by the RDN.

 

 

 

13.

FAIRWINDS CENTRE HOURS

 

Date:

October 2003

 

Issue:

Residents wanted longer open hours;  6 month membership or drop in fees.

 

Steps taken by FCA:

FCA did nothing.  The Fairwinds Centre is a privately owned business and it is up to them and the membership to determine any changes.  Advised those wanting a change should contact Amy Hadikin or management.

 

Resolution:

Concluded.

 

 

 

14.

FIRE DEPARTMENT COVERAGE FOR FAIRWINDS

Issue:

How can we help to keep our Volunteer Fire station up to date.

15.

FUTURE OF FAIRWINDS

Issue:

With the latest sale of Fairwinds Community & Resort, what does the new owner see for the future development of the community.

 

Steps taken by FCA:

The management would like to see a community where people can age in place.  Homes and town-homes are here now, they would like to see extended care suites be built also.

     
16. GOLF CART

License (24.02 Section 4a) For the purpose of general transportation a golf cart must be registered, insured and licensed

Operation on Roads: (24.02 Section 5)  Can only operate on a provincial road when crossing said roadway from one part of a golf course to another part of the same golf course.

   

17.

GRANITE SHARES OF GOLF COURSE

Issue:

Granite share holders wanted an update on the status of their shares.

 

Steps taken by FCA:

This is a Golf Society issue and the FCA left it with them for clarification

Still being dealt with by Golf Society

 

 

 

18.

MEMBERSHIP IN FCA

 

Date:

ongoing

 

Issue:

The FCA needs members.  We have approximately 500 homes/lots sold but only 25% of the households are members.  How can we increase this.

 

Steps taken by FCA:

A welcoming committee was formed.  This committee will go to every new household, shortly after the new owners move in, with information about the area and community.  As the community grew, the committee could not handle the increase.  Committee discontinued in April 2006.

FCA designed a brochure to be given to all new people to encourage membership.  Fairwinds now prints the brochure and has it available in their real estate office.

bullet

FCA hosts a summer picnic to help new people meet other residents. April 2005 only a dozen came to the picnic.  No longer being held due to poor attendance and cost as Fairwinds will not assist.

The welcoming committee is being enlarged as they found it hard to keep up with all the new residents in 2003/04.    In conjunction with Fairwinds Centre we are hosting a welcoming tea.

Committee cancelled as they could not keep up with growth.  Tea/Picnic or any social not held due to poor attendance and cost involved.  Fairwinds Centre would not assist with cost but took all the recognition when it was held.

 

 

 

19.

NOISE BYLAWS

 

Date:

April 2003

 

Issue:

Two separate noise concerns.  First regarding the Fairwinds Golf Course mowing the laws at 6:00 am.  The second in regards to heavy equipment on construction sites working on Sundays.

 

Steps taken by FCA:

The RDN Bylaws were looked into regarding noise and hours of construction.  Both items are exempt from the noise bylaws.  Golf courses have no hour restrictions on their equipment.   Due to the cost of large machinery, having it sit idle at a construction site is exorbitant so it is also exempt from the noise bylaws.  It has a time restriction of 7:00 am until dusk but do not have a day of the week restriction.

20.

PARK ACCESS & MAINTENANCE

October2002;  October 2006

 

Issue:

Designated park areas are getting overgrown and access is difficult.  October 2006 - what steps has the FCA taken to ensure ongoing maintenance and development of path system.

 

Steps taken by FCA:

Parks and Recreation supply funds to residents who would like to take on this project.   A work bee was arranged.   October 2006 - FCA have given input regarding pathways to the Fairwinds Development committee.

 

Resolution:  Spring 2003

Work parties were organized and the areas in question were cleaned up and access ways developed.

 

 

 

21.

PERCEIVED BIAS TOWARDS FAIRWINDS RESIDENTS

 

Date:

April 2003

 

Issue:

Perception that residents of Fairwinds are not accepted by other residents of Nanoose Bay.  This was apparent when petition to stop the development of a second golf course was being circulated.  Non Fairwinds Community residents felt that is was the residents of Fairwinds Community & Resort that were benefiting financially from another golf course, which they opposed.

 

Steps taken by FCA:

FCA have a member on the NPORA (Nanoose Bay Resident Association)

FCA in contact with other Community associations and join them in support of issues that affect us all

 

Resolution:  April 2004

This perception is still there and Fairwinds Centre didn't help when they put in a dual membership fee with residents of Fairwinds getting a better rate than non-Fairwinds residents.

 

 

 

22.

REALTY OFFICE RELOCATION

 

Date:

April 2003

 

Issue:

Realty office on Fairwinds Drive was to be removed by Feb 2003.  They applied for and received an extension until they could relocate to another similar building on Andover next to the current condominiums.  This was petitioned against by residents.

 

Steps taken by FCA:

notice of hearing on relocation was announced and well attended by residents.

relocation to Andover road was denied.

bullet

removal of Office to be done by summer 2003.

 

Resolution: April 2006

Fairwinds Property Development office maintained in Fairwinds Centre or they will develop onsite office when phase opened.

No longer a FCA issue.

 

 

 

23.

ROOFING MATERIAL USED IN ARBUTUS HILL

 

Date:

April 2003

 

Issue:

Covenants in all phases of Fairwinds Community & Resort state only shake, cement and ceramic roofing can be used but Intercorp (housing developer for Arbutus Hill) has put ashphalt looking shingles on their show home.  Why are they exempt from covenant regulations.

 

Steps taken by FCA:

FCA asked for a copy of the Arbutus Hill Covenants but was refused access.

bullet

the subject material was looked into.  It is a fibreglass construction and has a 50 year guarantee so will last better than ashphalt shingles would.

bullet

exemption was made because it is a stand alone phase.  Future phases that abut existing phases will not get these exemptions.

bullet

FCA found out that the new material fades after 5 years and look is not maintained.

 

Resolution:  April 2004

Fairwinds approves what they want.  There is a statement in all building guidelines that Fairwinds can approve changes when necessary.  This clause they use regularly.

 

 

 

24.

RECREATIONAL VEHICLE PARKING AREA

Issue:

When Fairwinds was first being developed in 1990, the development company said it would look for a secure spot on which RV's could be parked.  Was this still being looked into?

 

Steps taken by FCA:

The Fairwinds Community & Resort manager was asked and he stated that they were still looking into this.  One idea was the land next to the DND entrance could be leased.  This property was already behind the gate and thus secure.  Other areas were looked at but security was the issue as it would need 24/7 monitoring.  DND land is no longer available.  Due to 911 issues, security will not allow non military personnel on the base unescorted.  FCA continues to keep this issue before management.

 

 

 

25.

SIDEWALKS - MAINTENANCE & REPAIR

Issue:

Sidewalks in the area are starting to breakdown due to weed growth, negligence, contractor's building practices, vehicles parking on sidewalks as stress cracks.  Who repairs these or maintains them.

 

Steps taken by FCA:

Wrote to and phone RDN:  they advise that when Fairwinds Community & Resort was first being developed the RDN did not approve sidewalks or street lighting as these features are not supported in this area.  They advised FC&R that if they went forward with these items, they would have to make arrangements with the Ministry of Transport or take care of it themselves.

Wrote to and phoned MOT:   They cover only curb to curb.  They will not maintain sidewalks.

October 31, 2003 - In a letter to the FCA, the  Ministry of Transportation confirmed that the Developer had agreed to maintain the sidewalks as a condition of MOT's approval of the Fairwinds development.

Wrote and phoned Penreal Management Company.  They were never advised of this when they purchased Fairwinds and therefore do not accept the responsibility.  They advise we should contact the original owner of Fairwinds that made/did not make the agreement

Talked to RDN about costs involved to have sidewalks brought up to full repair and the cost of having a line item on taxes to cover future repair.

SPEED LIMIT INCREASE ON POWDER POINT ROAD

Issue:

Motion at meeting made that speed limit be raised from 50 kph to 70-80 kph

 

Steps taken by FCA:

Letters sent to MOT and Pauline Bibby to look at this issue.  Pauline sent out a questionnaire to constituents and received resounding disapproval by Nanoose Bay residents in general. 

 

Resolution:

Increase denied.

WATER QUALITY & QUANTITY

Issue:

Several residents inquired as to the quality of the drinking water as it appeared cloudy and murky.  The water does contain iron due to the fact that it is well water.

Steps taken by FCA:

December 2003 - Letter to RDN asking about the quality of the water in Fairwinds Community & Resort and what is being done to improve this condition.  It was noted at the time of the writing that the RDN was flushing the drains which would account for the sudden onset of murky water.  This condition should clear up in a couple of days.

a community wide representation is being sought to form a committee which will look a water conservation ideas to be presented to the community members.

January 2007 - a meeting was held with the RDN and the community at Schooner Cove.  The RDN promises to work to correct the situation but we need to keep on them until it happens.

28. NOISE BYLAW
  Date: October 20, 2004
  Issue: Regarding Homes being built.  They seemed to be starting early (8:00am) and often still working at 6:00pm.  What are the noise bylaw restrictions.
  Steps taken by FCA: A copy of the RDN Noise Bylaw is attached
  Resolution: Contractors have a window of 7:00am to 10:00pm to work. 
     
29 YARD WASTE PICKUP
  Date: October 20, 2004
  Issue: Is there a company that will pick up yard waste in the area.
  Resolution: Yard waste pickup.  Put in clear plastic yard waste bags or garbage pails.  Small branches cut up and bundled together will be picked up as well.  Nominal fee charged.

30 WATER STAINS IN SINKS (Removal of)
  Date: April 20, 2005
  Issue: Iron in water stains sinks and toilets and cannot be removed
  Resolution: Water has iron and manganese in it.  This is controlled by chlorine by the RDN and is deemed safe to drink but the water does stain the fixtures.

Remedies:

  1. Add 1 tablespoon of CITRIC ACID powder (available economically in 1 kb bulk at the health food store at Red Gap) to the toilet bowl and swish it around with a toilet brush.  Stains disappear in minutes.  Then add another tablespoon to the tank and it will also clear.   Repeat as needed.
  2. "Iron Out" powder, purchased at Canadian Tire, Quality Foods, Walmart works the same way as Citric Acid above.
  3. Stubborn stains or heavy build up stains can be easily removed with the application of a PLUMIE HEAVY DUTY SCOURING STICK available at Home Hardware stores for about $5.00.
   
31. COMMUNICATION WITH RESIDENTS
  Date: April 20, 2005
  Issue: No longer have community newletter "Good News" to get information out to the residents.
  Resolution: It was suggested that we make up an Electronic Newsletter to send out the members for whom we have e-mail addresses.  We can include an "unsubscribe" to the initial mail out and also promote those we don't have email's for contacting us via the website to get added on.
